The Rundown: Elon Musk’s SpaceX filed a lawsuit this week — saying the DOJ's administrative case alleging anti-immigrant bias is unconstitutional and should be heard in court.

Key points:

  • The DOJ complaint says SpaceX refused to hire non-citizens from 2018-2022, wrongly claiming export laws barred it.

  • But SpaceX argues DOJ judges are improperly appointed, violating the Constitution's appointment clause.

  • SpaceX also says seeking monetary penalties means the case must go through courts, not administrative proceedings.

  • This follows a 2022 appeals court ruling SEC in-house judges were unconstitutional — which will be reviewed by the Supreme Court.

Why it matters: Between his grand visions for X as the ‘everything app,’ fighting the government in court, and pushing boundaries with Tesla — Elon Musk certainly has his hands full. But his tussles with the top regulators are likely far from over.
